AutoSetter offers an AI-powered SaaS platform that allows you to connect an Instagram profile via the official Meta Graph API to automate conversations in direct messages (DMs) and comments with followers and other users.

For the purposes of these Terms, the term "Services" includes:

• The website and all subdomains
• The platform's web functionalities and dashboard
• Any content, software, features, or tools offered
• AI agents and automation capabilities
• Any electronic communication sent by AutoSetter

Access to certain features may be subject to a paid subscription, as stipulated in the Payments and Refunds section.

2.1. By registering on the platform or using any part of the Services, you represent that you have read, understood, and accepted these Terms.

2.2. You also accept our Privacy Policy, which is expressly incorporated into these Terms by reference. If you disagree with any provision, do not use our Services.

2.3. AutoSetter may modify these Terms at any time. We will notify you of any material change by email or a notice within the platform. Continued use of the Services after such modifications implies your acceptance.

3.1. To use AutoSetter, you must be at least 16 years old.

3.2. If you reside in a jurisdiction where the legal age of majority is higher, you represent that you have authorization from your legal representative to use these Services.

3.3. AutoSetter reserves the right to suspend or delete any account if it has reason to believe it was created by a minor or in violation of these Terms.

AutoSetter uses artificial intelligence systems to automate conversations in direct messages and comments of accounts connected through Instagram's official API. Platform-generated responses are automated, may vary in tone, content, or accuracy, and are subject to current technological limitations of AI.

You acknowledge and agree that:

• AI-generated responses do not constitute professional recommendations or personalized business advice.
• You are solely responsible for the content delivered through your Instagram account, even if it was generated automatically by the system.
• It is your responsibility to review and supervise automated messages sent from your account.
• AutoSetter does not guarantee specific results regarding sales, audience growth, or business performance.
• The platform is an automated support tool that depends on the context of use, the quality of your content, and your external business strategy.

AutoSetter is integrated with Instagram's official API via Meta for Developers. However, it is not affiliated with, sponsored by, or endorsed by Meta Platforms Inc.

Any changes in usage policies, technical limitations, or temporary blocks imposed by Meta on the API may affect the operation of the Services, and AutoSetter has no control over this.

The AutoSetter website may contain links to third-party resources, articles, or tools. These are provided for informational reference only. We do not control or guarantee the availability, accuracy, or security of these external sites.

To use the Services, you must register and create a user account on our website. During registration, you will be asked to provide accurate and up-to-date information.

You are solely responsible for maintaining the confidentiality of your login credentials. If you suspect unauthorized access to your account, you must notify azerorisk@gmail.com immediately.

By connecting your Instagram account to the platform, you authorize AutoSetter to generate and send automated messages on your behalf via DMs and comments. You expressly agree that you bear sole legal responsibility for the content of those messages.

AutoSetter reserves the right to suspend or terminate your access to the Services if suspicious, illegal, or Terms-violating activity is detected.

All content on the AutoSetter platform is the exclusive property of Ecological Industries Madrid S.L. or its licensors. You may not copy, distribute, modify, or reverse-engineer the software.

AutoSetter grants you a personal, limited, non-transferable license to access the Services solely for legitimate business purposes related to your Instagram account.

By connecting your account, you authorize the access and storage of certain data necessary to provide the service: username, account ID, messages, followers, etc. This data is used only to automate and personalize the experience within the Services.

You may request deletion of your account and all associated data at any time, in accordance with our Privacy Policy and through our Data Deletion page.

AutoSetter offers monthly or annual subscription plans. Premium features require a paid subscription.

Payments are processed securely by Stripe. You agree that the subscription renews automatically unless you cancel manually before the next period.

Purchases are non-refundable, except where required by mandatory law or for a technical error attributable to the platform. Requests must be sent to azerorisk@gmail.com.

European Union users may withdraw from the contract within the first 14 days, provided they have not begun using premium features.

The following are prohibited:

• Using AutoSetter to send spam, deceptive or offensive messages, or messages that violate Instagram's policies.
• Automating interactions from fake or unauthorized accounts.
• Sharing sexual, violent, discriminatory, or illegal content.
• Scraping, reverse-engineering, or replicating the software.
• Interfering with the security, operation, or availability of the service.
• Using the service for any illegal or fraudulent purpose.
• Attempting to gain unauthorized access to other users' accounts or data.

You are solely responsible for any AI-generated content sent from your account. Misuse may result in immediate suspension without refund.

9.1 Indemnification

You agree to indemnify AutoSetter against any claims arising from misuse of the service or from automated content generated from your account.

9.2 Disclaimer of Warranties

The Services are provided "as is," without warranties of uninterrupted operation, accuracy, or specific results. We do not guarantee that the service will be error-free or that defects will be corrected.

9.3 Limitation of Liability

AUTOSETTER'S LIABILITY IS LIMITED, IN ANY EVENT, TO THE TOTAL AMOUNT PAID BY THE USER IN THE LAST 12 MONTHS OR US $100, WHICHEVER IS LESS. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

AutoSetter operates under the laws of the United States. If you reside outside the U.S., you are responsible for complying with local laws.

Any dispute will preferably be resolved amicably. Otherwise:

• Users outside the EU: binding arbitration in the United States.
• Users in the EU: may bring claims before the courts of their country and/or use the ODR platform: https://ec.europa.eu/odr

We are committed to protecting your privacy and personal data in accordance with applicable data protection laws, including GDPR for EU users and CCPA for California residents.

You have the right to access, correct, delete, and port your personal data. To exercise these rights, visit our Data Deletion page or contact our Data Protection Officer at azerorisk@gmail.com.

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including:

• Breach of these Terms
• Violation of Instagram/Meta policies
• Non-payment of subscription fees
• Fraudulent or illegal activity
• Request by law enforcement

Upon termination, your right to use the Services will cease immediately. You may terminate your account at any time through your account settings.

These Terms constitute the entire agreement between you and AutoSetter. If any provision is deemed invalid, the remaining provisions will remain in force.

AutoSetter may assign this contract to another entity without prior notice. All communications will be deemed electronic and binding.

We reserve the right to modify or discontinue any aspect of the Services at any time without prior notice.
